In Kris vs. James saga, both are losers

The continuing saga of Kris Aquino’s intent to end her marriage to James Yap has reached a dramatic turn after the TV host-actress’ lawyer, Anna Liza Logan, announced that her client was seeking nullity of marriage, saying that their marriage was void from the beginning.

Proving this will definitely open a sort of Pandora’s Box in their marriage.

While other grounds for nullity of marriage may not seem to apply to them, such as the age requirement or the qualification of the person who solemnized their bond as husband and wife (then Quezon City mayor Sonny Belmonte, no less), her lawyers would seem to have no other recourse but to push for the obvious bases — either psychological incapacity or bigamous or polygamous marriages.

According to the Family Code: “Any psychological incapacity at the time of the marriage celebration, which prevents either the husband or wife from fulfilling the essential marital obligations of marriage, shall also be void even if such incapacity becomes manifest only after the solemnization.”

This means the petition Kris will file before the Quezon City Regional Trial Court will include allegations of psychological incapacity against James after their marriage that should consist of incidents that prove such — certainly presenting a never-before-seen or heard inside look on this popular yet controversial union. Who knows? Maybe allegations of a previous “bigamous or polygamous” marriage against James may crop up.

As with Liz Almoro’s successful nullity of marriage petition against ex-husband Willie Revillame in 2006, the details should be as ghastly and turbid as one can imagine. Probably even more so , as Liz and Willie’s marriage lasted just over a year, while Kris and James’ union lasted for five years, which would bring a grander, expanded presentation of their alleged woes. For sure, details on James’ alleged past affairs could come to the fore as with Kris’ own shortcomings as a mother or wife, in addition to other shocking incidents or lurid facts that would surely scorch TV talk shows, news programs, daily broadsheets and tabloids in the weeks or months to come.

Unlike Liz’s case, however, it is quite unlikely that this nullity of marriage petition will carry a charge in violation of Republic Act 9262 or the Anti-Violence Against Women and Their Children Act. But expect those nasty rumors through the years on James’ alleged infidelity to receive striking emphasis. With previous allegations against James of infidelity, it is expected that the case will raise James’ alleged affiliations with other women, most notably Hope Centeno, a former receptionist at the Belo Medical Clinic, and the more recent alleged romance with fan Mayen Austria. But expect more of those alleged “affairs” to emerge as the case goes to court.

Sadly, this case will further place the family under close public scrutiny and may even bring up closely guarded secrets that may affect ultimately the whole Aquino clan, not just James Yap. In fact, James can file countercharges of his own, which should bring up allegations that would also put his popular spouse in a bad light. As the case wears on, it is obvious no one will really emerge a victor in their respective families. Only losers.

Winners? Well, the media will surely have a frenzy and happy trips to the bank, and those talkative regulars in neighborhood sari-sari stores, a field day in juicy exchanges that would last a lifetime.

While one party, in this case Kris, may be granted the petition, just imagine the damage, and the collateral damage that could happen.

What could be a better option for both of them? Maybe they could learn a thing or two from couples like Yayo Aguila and William Martinez, who despite their separation, still constructively worked things out in terms of rearing their children and other family matters. In other words, the family still exists despite the separation.

Of course, we do not know or take the rightful place in deciding the best option for them. But isn’t giving it another thought, or a few minutes of dialogue, to saving their marriage still worth it?

I believe it is.

Text message scammers, beware. Your random text messages asking for prepaid load might have reached President Benigno “Noynoy” Aquino III.

Aquino admitted he has been getting weird text messages. He also once replied to someone pretending to be his relative.

“Ang masakit pati scam. Kamusta na kayo diyan, ito na ang bagong roaming ko. Paulit-ulit din. Noong isang beses, nang hindi ko pa alam na scam ‘yon, sinagot ko na, ‘Who is this please? Mukha hong missend.’ Sagot, kapatid mo,” Aquino told reporters when asked if he still has the time to send text messages.

Amused, Aquino sent the apparent scammer a reply: “Wala akong kapatid sa abroad, good night sa inyo.”

Aquino’s sisters Ballsy, Pinky, Viel, and Kris all live in the Philippines.

“Noong una, naaawa ako na baka nagkakamali ito, hindi pa niya nakausap ang kamag-anak niya. Pero nakabalik ng tatlong beses, loko itong mga ito,” Aquino said.

Aquino said he has also been getting text messages that were offering car or housing loans.

Aquino said he is now tempted to change his number.

The President said he is now checking or replying to text messages in the morning and in the evening before he goes to sleep.

“So ang pinaka-practical, umpisa ng araw at bago matapos ang araw,” said Aquino.

Kris says it’s also final: ‘It’s over’

Despite James Yap’s statement that his decision was “final” that he would “fight to save” his marriage to Kris Aquino, the actress-TV host made this clear in a statement Boy Abunda read on ‘The Buzz’ last July 11.

Kris released the statement amid speculation about her next move amid James’ pronouncements. She went to the US recently for a vacation and was unreachable for any comment. Her trip obviously served as a means to think things over and plan her next action.

But after taking all things into consideration—including the view of her family, the future of their son Baby James, and the pros and cons of reconciling or ending their marriage, Kris has now reached a “final” decision.

The statement, composed by her lawyers, reads:

“Ms. Kris Aquino has recently announced that she has decided to end her marriage to James Yap and asked us to initiate the appropriate proceedings for the purpose she believes that this is the best interest of all concerned especially her children. We shall take the necessary steps at the soonest possible time and request everybody to respect the privacy of the parties and let the legal process take its course.”

While she did not mention the specific “proceedings” she was referring to—a mere legal separation or annulling their near six-year marriage, Kris reiterated she was not departing from her June 27 statement, which emphasized that for her part, her marriage to James is “over.”

This announcement came a day after their sixth wedding anniversary.

Interestingly on the other channel, another ex-husband of Kris spoke about their separation:

“Ah, sa ating lahat, Diyos lang naman ang nakakaalam ng lahat, ng totoong kuwento sa ating buhay and ang sa amin lang, we need to continue praying for them, not just for Kris and for James, kasi sayang naman,” actor Phillip Salvador says.

“Mahaba na ang itinakbo ng relasyon nila, ang dami na nilang bagyong pinagdaanan. Pero nasa kanila pa rin ‘yan,” he adds.

Asked who he pities more if the separation indeed pushes through, Kris or James, Phillip says:

“I don’t know this person (James) kaya hindi ako puwedeng magkumento ng kahit na anupaman tungkol sa kanya. I don’t know him, I know Kris, kaya naaawa ako sa kanya.”

Regine Velasquez reportedly gave boyfriend Ogie Alcasid a black BMW Series 7 luxury car

Slideshow: Showbiz Photos

Paliwanag niya, "I know that buying lavish things is not practical. Pero ano ang magagawa mo kung mahal mo, di ba? Siyempre, ibibigay mo talaga ang sa tingin mo magugustuhan ng partner mo, di ba? You know, habang kaya, habang bata pa at kaya."

Palagi akong nagte-taping. Pang-kabuhayan showcase! So, yun."

Ex-Arroyo aide may turn state witness: Philippines' Aquino

Philippine President Benigno Aquino gestures during his first media briefing at the Malacanang Palace in Manila. A former minister in the government of ex-Philippine leader Gloria Arroyo could be used as a state witness in a corruption case against her, Aquino said Wednesday.

MANILA (AFP) - – A former minister in the government of ex-Philippine leader Gloria Arroyo could be used as a state witness in a corruption case against her, President Benigno Aquino said Wednesday.

Aquino said he recently met former agriculture minister Cito Lorenzo and told him the government wanted him to testify against Arroyo in one of the many scandals that rocked her government.

"I did not have the occasion to talk to him extensively when I saw him, but I did say that 'I have a lot of questions for you' and I left it at that," Aquino told reporters.

Asked whether a recently created "truth commission" tasked to go after Arroyo over alleged corruption would get Lorenzo as a witness, Aquino said: "That is a possibility".

"It is an accepted doctrine that the person with the least guilt who can help you in prosecution is afforded certain privileges, among them immunity from suit," he said.

Aquino said the brief exchange occurred during a private party thrown by one of his aides.

Lorenzo was the agriculture minister when about 728 million pesos (15.68 million dollars) intended as fertilizer funds for small farmers was allegedly diverted to Arroyo's election campaign in 2004.

Arroyo eventually won the election by a slim margin amid widespread allegations of cheating, including vote buying and influence peddling.

Lorenzo fled the country two years later when the Senate launched an investigation into the scandal. It is unclear when Lorenzo returned to the Philippines.

Aquino said that Lorenzo told him while in exile through emissaries that he feared for his life.

"If he has damaging information on certain parties, then the revelation will serve some sort of safeguard for his own safety," Aquino said.

"Keeping it in limbo, not putting it on the public record does not help his cause.'

Aquino won the presidency by a landslide in May, largely on a promise to rid government of corruption weighing down the impoverished country.

Among his first orders when he assumed office last week was to appoint a retired Supreme Court justice to head the "truth commission" that would go after Arroyo, who was required by constitutional term limits to step down.

'Django' Bustamante captures elusive World 9-Ball title

'Django' Bustamante captures elusive World 9-Ball title

MANILA, Philippines – (UPDATE) Francisco “Django” Bustamante reigned supreme in the 2010 World Pool Championships (World 9-Ball), defeating Taiwanese “The Little" Monster” Kuo Po-cheng, 13-7, in the final.

“Sa wakas nakumpleto na din ang pagiging bilyarista natin. Lahat kasi ito ang pangarap maging WPA World 9-ball champion,” Bustamante said after winning his match at the Qatar Billiards and Snooker Federation hall in Doha, Qatar early Tuesday morning (Manila time).

“Salamat sa Diyos ito na lang ang missing sa career ni Django,” said Philippine Billiards godather Aristeo “Putch” Puyat of Puyat Sports, a long-time benefactor of Bustamante.

On the way to the final, Bustamante beat compatriot Antonio “Nickoy” Lining, 11-5, in the semifinal round to arrange a titular showdown with Kuo who edged Johnny Archer of the United States, 11-10.

Bustamante took the top prize of $36,000, Kuo settled for $18,000 while Lining and Archer got $10,000 each.

The WPA World 9-Ball was Bustamante’s 4th championship this year after previously being a member of the winning Team Asia that routed Team Europe last January 17 in the Asia vs Europe Challenge Match.

He defeated Puyat Sports stable mate Reyes to win the 23rd Annual Japan Open — Open Division in March and took home the inaugural World Professional Billiard League (WPBL) championship in Winnipeg Canada in June.

2002 heartbreak

The World Pool title seemed to be elusive for the Tarlac City native Bustamante.

Although he made it to the World Pool Championships final in 2002 in Cardiff, Wales, he was unsuccessful against American Earl “The Pearl” Strickland.

At the height of the tournament, Bustamante received a shocking phone call from his wife informing him that his daughter, who was less than a year old, had died.

Bustamante strongly considered forfeiting his participation, but his wife somehow convinced him that their child would have wanted him to continue to fight.

In the final, Bustamante was leading Strickland, 15-13, but the American went through with a 17-15 victory. – With reports from Ronnie Nathanielsz, PhilBoxing.com and Marlon Bernardino
